OneGarage Terms of Service
Crucial Disclaimers & Limitations Summary
Please read these terms carefully before using OneGarage. By creating an account, uploading vehicle records, or viewing Resale Passports, you agree to be bound by these terms, including our strict disclaimers regarding mechanical advice, vehicle valuations, and platform liability.
01. Acceptance of Terms & Eligibility
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and WoodsLogic Pty Ltd ("WoodsLogic", "OneGarage", "we", "us", or "our") governing your access to and use of the OneGarage web application, services, and associated domains.
By registering an account, clicking "Enroll Account", uploading documents, or utilizing OneGarage, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into these Terms, and agree to comply with all applicable local, state, and national laws.
02. No Mechanical or Engineering Advice
OneGarage and WoodsLogic Pty Ltd are NOT certified motor vehicle mechanics, automotive engineers, or licensed motor vehicle repairers.
- Informational Reference Only: All service schedules, mileage intervals (e.g., 10,000 km minor service, 30,000 km valve checks), health indicators (Healthy, Due Soon, Overdue), and known chassis bulletins (TSBs) are algorithmically aggregated from public OEM manufacturer handbooks for general reference purposes only.
- Owner Responsibility: You retain sole and exclusive responsibility for verifying all service intervals, torque specifications, fluid requirements, and mechanical safety with certified technicians or authorized dealership service departments.
- Disclaimer of Damages: WoodsLogic disclaims all liability for vehicle breakdown, component failure, engine seizure, road traffic accidents, personal injury, death, property damage, loss of vehicle warranty, or consequential damages resulting directly or indirectly from your reliance on OneGarage intervals, reminders, or health statuses.
03. Valuation & Market Pricing Disclaimers (RedBook Guides)
OneGarage is NOT a licensed motor car trader, certified motor vehicle valuer, insurer, or financial advisory service.
- Algorithmic Estimates: All estimated market value ranges ("RedBook Guide", "Private Sale Guide", "Dealer Retail Guide", "Trade-in Guide", and "Pedigree Premium %") are algorithmic estimations derived from historical market data and do not constitute formal appraisals or guaranteed sale prices.
- No Guarantee of Realized Value: Real-world market values fluctuate based on physical condition, tire wear, accident history, geographic location, and buyer demand. WoodsLogic makes no representation or warranty regarding the price you may receive when selling or trading your vehicle.
- Trading Risk: You are solely responsible for any decisions made to buy, sell, trade, or finance a vehicle. WoodsLogic accepts zero liability for financial losses, undervalued sales, or overpaid purchases.
04. User Uploads, Document Accuracy & License
When you upload invoices, repair dockets, receipts, dyno charts, or vehicle photographs to OneGarage:
- User Ownership & Warranties: You retain ownership of all images and documents you upload. You represent and warrant that you own or have obtained the necessary rights, licenses, and permissions to upload the documents, and that all submitted information is authentic and accurate.
- Platform License: You grant WoodsLogic a non-exclusive, worldwide, royalty-free license to host, store, parse via optical OCR, and display your uploaded content solely for the purpose of operating and delivering the OneGarage service.
- Prohibited Content: You must NOT upload documents containing fraudulent invoices, forged stamps, malware, illegal content, or unredacted confidential third-party financial data (such as bank account numbers or credit card CVV codes).
05. Public Resale Passports & Buyer Notice
OneGarage provides public Resale Passports (/onegarage/passport/[id]) as a tool for owners to share their documented maintenance logs.
Buyer Pre-Purchase Inspection Notice:
OneGarage Resale Passports reflect owner-submitted service logs and AI-parsed invoices. A OneGarage Passport:
- Does NOT constitute a statutory Roadworthy Certificate (RWC), Safety Certificate, or Pink Slip.
- Does NOT replace a formal government encumbrance or write-off check (e.g., Australian PPSR or Carfax).
- Does NOT substitute for a comprehensive hands-on mechanical pre-purchase inspection by an independent qualified mechanic.
06. Subscriptions, Free Credits & Cancellations
- Free Tier & Trial: Free accounts receive complimentary OCR scanning credits. Pro tiers include unlimited AI invoice scanning and multi-vehicle garage management.
- Billing & Auto-Renewal: Pro subscriptions are billed in advance on a recurring monthly ($7.99 AUD) or annual ($69.00 AUD) basis via Stripe. Subscriptions renew automatically unless cancelled prior to the end of the current billing period.
- 1-Click Cancellation: You can cancel your Pro subscription at any time directly in the OneGarage App settings. Upon cancellation, your Pro features remain active until the conclusion of your current paid billing cycle.
- Australian Consumer Law (ACL): Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded.
07. Trademarks & Nominal Fair Use
All vehicle manufacturer names, brand logos, model designations, and trim badges (including but not limited to KTM, Porsche, BMW, Renault, Ducati, Brembo, Motorex, and RedBook) are registered trademarks of their respective owners. Their mention on OneGarage is strictly for descriptive identification purposes under nominative fair use. OneGarage and WoodsLogic are independent and have no official affiliation with or endorsement from any vehicle manufacturer.
08. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable law, in no event shall WoodsLogic Pty Ltd, its directors, employees, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, vehicle value depreciation, mechanical damage, or data loss.
You agree to defend, indemnify, and hold harmless WoodsLogic Pty Ltd from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the platform, your uploaded content, or your violation of these Terms.
09. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to conflict of law principles. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for resolving any dispute arising under these Terms.
